be invited to buy goods from us. A legally
binding contract between you and the seller
for the sale of any goods will only arise
when the seller has received payment for the
goods in full from you and accepted your order
by despatch of the goods. By entering into
this contract you agree to be bound by our
terms and conditions. Receipt of your order
from this web site will be acknowledged by
email to the e-mail address given by you on
your enquiry form unless you advise us otherwise.
We do not support any form of price fixing
so you will find variations in price for the
same machine in different shops.
Sewing machines and overlockers will normally
be supplied to you by a retail shop local
to you. Exceptionally, for example if there
is no such shop in a convenient position for
you, we will be prepared to sell you a sewing
machine or overlocker at the price prevailing
at that time which would be quoted to you
before you placed an order.

| Descriptions |
Illustrations
are not to scale and some variations in appearance
may occur. Specifications are subject to change
without notice but you will be advised of
any differences at the time of order and have
the opportunity to reconsider before your
order is processed. |

| Warranties |
All new
frister+rossmann sewing machines and overlockers
carry a 36 month parts and labour warranty
to the original purchaser. If a machine we
have supplied (directly or through one of
our authorised dealers) to a buyer in the
United Kingdom mainland is found to have a
manufacturing defect within 36 months of the
original purchase we will collect the machine
from the original purchaser at a UK mainland
address, deal with the fault and return the
machine free of charge to that address. This
warranty is invalidated if the machine has
been serviced, or any part of the case not
designed to be opened in normal use has been
opened , other than by us or by one of our
authorised dealers. |

We do

| Direct
Delivery |
Unless
you are notified in advance to the contrary
delivery will be to the address you have provided
on the order form within fourteen working
days after you have placed your order or clearance
of your cheque if applicable and in any event
within 30 days of the day after your order
was placed, or after the clearance of a cheque,
unless a later date is agreed by you. |

A working
day is deemed not to include a Saturday Sunday
or Public holiday.
Ownership of and responsibility for the goods
will pass to you once they have been paid
for and delivered to you. |

Frister+Rossmann
have a strong network of dedicated dealers
and would recommend that, where possible,
customers purchase from their local dealer.
They will be able to offer advice, accessories,
follow up tuition and any future servicing
that the customer may require. |

| Our
right to cancel |
We reserve
the right to cancel your order if the goods
you have ordered are unavailable or discontinued,
one or more of the items you ordered was listed
at an incorrect price due to a typographical
error or an error in the pricing information
made by us and/or received by us from our
suppliers. |

If the
goods you order are unavailable we will notify
you as soon as possible and offer a suitable
alternative or to cancel your order. |
| |
If we
do cancel your order we will notify you by
e-mail or in writing, whichever is appropriate,
and will credit to your account any sum deducted
by us from your debit or credit card or by
return cheque, whichever is appropriate, as
soon as possible but in any event within 30
days of your order. You will not be entitled
to any additional compensation for disappointment
suffered. |

| Your
right to cancel |
We are
sure you will enjoy your purchase but if you
change your mind you may cancel your order
in writing to the seller at Frister &
Rossman Ltd 12 St Marys Drive, Stretton ,
Burton on Trent, Staffs DE13 0JJ,
United Kingdom within seven days after the
day following delivery. |

Following
such notice you may at your own expense (except
where goods are faulty) return to us any goods
delivered to you. Provided the goods are received
back by us unused, in new condition and in
the manufacturer's or seller's original packaging
by a recorded delivery service you will receive
a full refund of the purchase price. The goods
you return are your responsibility until received
by us so we strongly recommend that you buy
suitable insurance to cover the transit. |

If you
fail to return the goods at your own expense
(except where goods are faulty) including
any insurance costs we will be entitled to
deduct our costs incurred in recovering them
from you from your refund amount. Refunds
will be made within thirty days of receipt
of your written notice. |

Under
no circumstances, other than in the event
of faulty goods, will refunds be considered
where the manufacturer’s seal has been broken
or the packaging of any "software",
medium carrying computer files, memory cards
or sticks, disks, Compact Disks (CDs) Digital
Versatile Disks (DVDs) or diskettes, has been
opened or interfered with. |

The goods
you return are your responsibility until received
by us so we strongly recommend that you buy
suitable insurance to cover the transit. |

If you
fail to return the goods at your own expense
(except where goods are faulty) including
any insurance costs we will be entitled to

will be made within thirty days of receipt
of your written notice. Any software on which
the seal has been broken will not be accepted
for refund unless faulty. |

| Payment |
By placing
an order you authorise the seller to process
a credit card, debit card or charge card payment
for the total sale amount. |

| Events
outside our control |
We shall
have no liability to you for any failure to
deliver goods you have ordered or for any
delay in doing so or for any damage or defect
to goods delivered that is caused by any event
or circumstance beyond our reasonable control
including, without limitation, third party
default, strikes, lock-outs and other industrial
disputes, breakdown of systems or network
access, flood, fire, explosion or accident. |

| Invalidation |
If any
part of these terms and conditions is unenforceable
(including any provision in which we exclude
our liability to you) the enforceability of
any other part of these conditions will not
be affected. |

| Applicable
Law |
In any
case of dispute the Courts of England &
Wales shall have jurisdiction and all matters
shall be settled in accordance with English
law. |

You
have a right to privacy. |

Policy |
We do
not collect any personal information about
individuals except where it is specifically,
knowingly and necessarily provided for an
order to be processed, your enquiry to be
dealt with or if you choose for your name
to be added to our newsletter list. |

There
is no spyware installed on this site, we cannot
scan your computer for personal information
nor would we wish to. |

Certain
contractors may have such access to information
you provide as is needed to fulfill their
contractual obligations to us. Such contractors
will include from time to time credit card
processing agencies, computer and information
technology suppliers and others concerned
with marketing, banking and security issues.
Contractors are not allowed to retain information
for their own activities. |

Web servers
record numbers of pages and pictures accessed
for pricing (to us!) and maintenance issues
not personal information on the visitors to
